Legally Exempt Child Care

What is Legally Exempt Child Care?

Legally exempt child care refers to care provided by someone who does not need a license or registration to offer child care services. Families that qualify for the Child Care Assistance Program can opt to have their children cared for by a 'legally exempt' child care provider. These providers work individually for each family based on their unique needs, and complete paperwork through our enrollment agency to be able to receive payment through the county for the care they provide. 


Types of Legally Exempt Child Care

  1. Family, Friend, and Neighbor Care
    • Family Child Care: Care provided in the caregiver’s home for up to 8 children. Only 2 children can stay for more than 3 hours at a time, unless the caregiver is closely related to all children.
  2. In-Home Child Care: Care provided in the child’s own home, with no limit on the number of children as long as all live in the home
  3. Group Programs
    • Programs under the supervision of an organization.
    • Independent group programs not affiliated with an organization.
